This Acceptable Use Policy (“AUP”) describes permitted and prohibited uses of the Poniq websites (including poniq.ai and app.poniq.ai, the “Site”) and the Poniq AI sales agent platform and related services (the “Service”) operated by Poniq, Inc., an independent California corporation founded in 2025. This AUP supplements our Terms of Service. Capitalized terms not defined here have the meanings in the Terms.
By accessing the Site or using the Service, you agree to this AUP. Violations may result in suspension or termination under the Terms.
1. Scope
This AUP applies to:
- Customers and their authorized users (employees, contractors, agencies acting on behalf of clients where permitted by plan).
- Visitors who interact with the Site (waitlist, marketing pages, documentation).
- End-users who interact with the Poniq agent embedded on customer websites (to the extent their conduct is attributable to or facilitated by a customer’s configuration or misuse).
Customers are responsible for how they deploy and configure the agent on their properties.
2. Lawful Use
You must use the Site and Service only in compliance with all applicable laws, regulations, and industry rules, including those governing:
- Privacy and data protection (e.g., GDPR, UK GDPR, CCPA/CPRA, and other state or national privacy laws).
- Electronic communications and marketing (e.g., CAN-SPAM, TCPA, ePrivacy, and similar telemarketing or SMS rules).
- Recording and monitoring consent (voice, video, and chat where recording or automated processing requires notice or consent).
- Consumer protection, advertising, and unfair or deceptive practices.
- Export controls and sanctions.
- Intellectual property, publicity, and confidentiality rights.
3. Prohibited Conduct
You may not, and may not permit others to:
3.1 Abuse, Harm, and Deception
- Engage in fraud, phishing, impersonation, or misrepresentation of identity or affiliation.
- Distribute malware, spyware, or harmful code through the Service or embed.
- Harass, threaten, defame, or discriminate against individuals.
- Generate or disseminate illegal, obscene, or infringing content.
3.2 Privacy and Sensitive Data
- Collect, process, or infer sensitive personal information (including health, financial, biometric, or children’s data) without all legally required notices, consents, and safeguards.
- Deploy the agent in regulated contexts (healthcare, financial services, insurance, legal, or similar) without appropriate licenses, policies, Business Associate Agreements (where required), and written confirmation from qualified counsel that your use is lawful.
- Use the Service to make solely automated decisions with legal or similarly significant effects on individuals without required disclosures and human oversight where mandated by law.
3.3 Communications and Outreach
- Send spam, bulk unsolicited messages, or use the Service to facilitate unlawful robocalls or texts.
- Bypass or circumvent consent requirements for calls, texts, or marketing emails.
- Misuse visitor data obtained through conversations for purposes incompatible with your privacy notice or our agreements.
3.4 Security and Integrity
- Probe, scan, or test vulnerabilities of the Site or Service without our prior written authorization.
- Bypass authentication, rate limits, access controls, or security measures.
- Reverse engineer, decompile, or attempt to extract source code or models except where prohibited by law.
- Interfere with or disrupt the Service, networks, or other users (including denial-of-service or unreasonable load).
- Access accounts or data you are not authorized to access.
3.5 Competitive and Automated Access
- Scrape, harvest, or systematically collect data from the Service except through documented APIs within published rate limits and the Terms.
- Use the Service to build or train a competing product or service, or for competitive benchmarking, without our prior written consent.
- Resell, sublicense, or white-label the Service except as expressly permitted in your plan or a separate agreement.
3.6 AI-Specific Misuse
- Rely on AI outputs without human review where your industry or use case requires professional judgment.
- Configure playbooks to provide medical, legal, financial, or other regulated advice presented as authoritative professional guidance.
- Conceal from visitors that they are interacting with an automated system where disclosure is required by law.
- Use the Service to generate or spread deliberate misinformation, election interference, or other manipulative campaigns.
4. Customer Responsibilities for Embedded Agents
If you embed the Poniq agent on your website(s), you are solely responsible for:
- Publishing a privacy notice that accurately describes conversation data collection and your use of Poniq as a processor.
- Obtaining and documenting any required consents (including for cookies on your site, automated processing, and follow-up communications).
- Configuring playbooks, escalation, and data fields appropriate to your industry and risk profile.
- Monitoring live and historical conversations and correcting harmful or non-compliant behavior promptly.
- Ensuring integrations (CRM, calendar, payments, webhooks) are used lawfully and only with data you have the right to share.
“HIPAA-aware” or similar workflow labels describe design considerations only. They do not mean Poniq provides HIPAA compliance or a BAA unless expressly agreed in writing.
5. Content Standards
Customer Data and AI-generated outputs must not:
- Infringe third-party intellectual property or proprietary rights.
- Violate confidentiality obligations or export control rules.
- Contain unlawful hate speech or content that exploits minors.
We may remove or block content that violates this AUP or poses risk, subject to the Terms.
6. Enforcement
We may investigate suspected violations and cooperate with law enforcement where required. Remedies include:
- Warning or required remediation.
- Temporary suspension of features or accounts.
- Termination of access without refund where permitted by the Terms.
- Legal action to protect Poniq, users, and the public.
We are not obligated to monitor all use but may use automated and manual review for security, abuse prevention, and legal compliance.
7. Reporting Violations

8. Changes
We may update this AUP from time to time. Material changes will be posted on this page with an updated “Last Updated” date and, where appropriate, additional notice to account holders. Continued use after the effective date constitutes acceptance to the extent permitted by law.
9. Relationship to Other Policies
This AUP is incorporated into the Terms of Service. Our Privacy Policy describes data practices. Our Subprocessor List describes infrastructure and service providers we use to deliver the Service.
